Terms of Services

Money Back Guarantee

All hosting accounts have a full money back guarantee (upon cancellation within 30 days of payment) if the account holder is not satisfied for any reason. The amount refunded will be the dollar amount paid to Gladstone Technologies Group, LLC, by the account holder, and it will be refunded to the bank account, credit or debit card or Paypal account the payment was originally paid from. Domain registration fees are not refundable under any circumstances. Additionally, if we register a domain name on your behalf as part of a free registration promotion, cancellation or termination of your hosting account will void the promotion offer and you will be charged $20 per year of registration remaining on your domain name registration.

You may cancel your hosting account at anytime and request a pro-rated refund. Refunds for hosting accounts cancelled after the first 30 days will be granted on the unused portion of services paid in advance. Any outstanding service fees, overage charges, or domain registration fees will be deducted before refund is granted. You may request cancellation of your account in writing through the Help Desk, via email, or by telephone at the contact number listed on the main Gladstone Technologies Group, LLC website.

Dedicated servers and virtual dedicated servers are not covered under any money back guarantee. Dedicated server cancellations must be submitted in writing or by telephone at least 14 days before your next invoice is due or you will be charged for an additional month. There are no partial refunds given for early termination.

Billing and Payment Cycles

Gladstone Technologies Group, LLC does not store credit card information and does not automatically charge you for services. We feel that this is in the best interest of your privacy and safety. You are responsible for remitting payment before the end of the billing cycle. Invoices are sent electronically to the email address that you have on file with us, approximately 2 weeks before your billing cycle ends. Printed invoices are available upon request only. We accept checks, PayPal, and most major credit cards.

You can choose to pay your invoices with PayPal Subscription service. Using this service, your personal and financial information are kept with PayPal, Inc. separately from our own records. You may at any time cancel your PayPal Subscription, but please note that this will not automatically cancel services purchased through Gladstone Technologies Group, LLC unless you have specifically requested cancellation. In the event of an accidental overpayment to Gladstone Technologies Group, LLC through the PayPal Subscription system, we will refund the overpaid balance once upon request. Any subsequent or future overpayments will be applied to your hosting account as a service credit. If you cancel your hosting account and still have Paypal Subscription credits left, you will lose those credits.

Services are invoiced approximately 14 days before your billing cycle ends, and reminders will be sent until the invoice reaches its due date. Overdue invoices are subject to a $10 late fee. Hosting accounts will be suspended once the invoice is 3 days past due, and they will be terminated once the invoice is 30 days past due. Your account may also be subject to a $15 reconnection fee unless otherwise noted in this document. Terminated accounts cannot be reinstated, and will cause your billing account to become due in full immediately. Please refer to the "Account Termination and Suspension" section for further details.

If, at any time, a chargeback is issued through your credit card company, bank or Paypal (including Paypal disputes) we will immediately suspend all services listed on your billing account, including services not covered under the chargeback or dispute, and start collection efforts. These same terms apply to overdue invoices. Suspended services may be subject to a reinstatement fee before they can be restored.

Contact Information

You are responsible for making sure that we have your current and correct contact information on file. We reserve the right to send policy announcements, tech support responses, and invoices relating to your hosting account(s). We do take privacy very seriously, and we will not sell, trade, or otherwise distribute your information to any third partiy unless specifically required by law. In turn, however: blacklisting, filtering, or reporting email from us as spam may be considered grounds for termination of your account. In the event that the contact information you provide to us is incorrect, outdated, or falsified, you will still be responsible for any and all obligations to Gladstone Technologies Group, LLC as outlined by your contract or service agreement.

Liability

We will make every reasonable attempt to avoid unexpected server downtime and to ensure that all hosting accounts experience reasonable (99th percentile) uptime. Any network problem, equipment/hardware failure, or other outage that is not covered under our Service Level Agreement will not be considered grounds for reimbursement for any subsequent financial damages or losses. All hosting account and data backups are the account holder's responsibility. Although we do make regular system-wide backups, Gladstone Technologies Group, LLC is not responsible for data backup integrity or subsequent loss. Shared hosting accounts should not be used for "mission critical" websites or email that require absolute protection. In addition, our services (managed or otherwise) are not guaranteed against any hacking attempt, denial of service attack, security breach, hardware failure, loss of use, loss of income and/or any unspecified general failures or any such incident arising from any of the aforementioned issues. By using the services of Gladstone Technologies Group, LLC, you agree that you will make no claim or attempt to collect for reimbursement of any financial loss or hardship caused by or related to our services. If you need fail-safe hosting services or a less restrictive liability policy, you may contact us at any time for special arrangements and related contracts.

Unsolicited E-mail (anti-spam policy)

Gladstone Technologies Group, LLC has a zero tolerance policy on unsolicited email and usegroup posts. Accounts caught sending unsolicited, mass, and/or bulk email or usenet postings, either through our servers or to promote a web site hosted on our servers will be terminated immediately, will not qualify for a refund, and will be charged a service fee of $50 per complaint filed. We reserve the exclusive right to determine what qualifies as "unsolicited," "mass," and/or "bulk." Accounts terminated for sending unsolicited email or usenet posts lose all rights to any content, files, backups and technical support associated with any and all accounts hosted on any and all Gladstone Technologies Group, LLC systems. Upon request, we will provide the source of the complaints and our findings in the matter, but we will not provide the complainants' individual contact information.

Gladstone Technologies Group, LLC also reserves the right to investigate accounts accused of sending unsolicited emails or usenet postings in any way deemed necessary. Accounts under investigation may be suspended at any time, and may be subject to a service fee depending on the results of the investigation. We suggest that you avoid posting on third party mailing lists, even if you have reason to believe that everyone on the list is "OK" with it. We are not unreasonable, but do understand that "I didn't know" might not be a sufficient excuse.

Additionally -- sites promoting, advertising or otherwise making available tools, information and/or software for the purpose of sending unsolicited email or usenet postings will cause their parent accounts to be terminated without notice.

Account Termination and Suspension

Violation of any of our Terms of Services will be grounds for immediate account termination. Web sites deemed offensive, pornographic or racially degrading, by Gladstone Technologies Group, LLC, will be removed from our servers without notice. Abusive behavior towards the Gladstone Technologies Group, LLC staff will not be tolerated and is grounds for immediate account termination. Any threats of legal action involving Gladstone Technologies Group, LLC, its owners and/or staff will be grounds for immediate termination.

Illegal activity will not be tolerated under any circumstances. Web sites promoting, making available or otherwise contributing to software piracy, hacking, spamming, denial of service attacks and/or damage to commercial networks or servers will be reported and suspended without notice. Any account activity resulting in a criminal charge or indictment is grounds for immediate termination.

Accounts using too many resources (to the point where said usage routinely or severely impacts services provided to other users) will be suspended without prior notice without fee or service charge. If an account is suspended due to resource usage, however, it will remain suspended until a solution is found. In this event, we will make a reasonable effort to offer advice and solutions that will help your account out of suspension. We will not debug your software programs -- account logs will be provided for your review for this purpose.

Certain scripts available on the internet have proven to be security risks, and as such are forbidden on our systems. Currently, this includes third-party installed versions of FormMail and any of the scripts available from the Matt Wright archive (www.scriptarchive.com). Also, accessing IRC through our systems is prohibited. You will receive one (1) warning if you attempt to access IRC or its related services through your hosting account, and your account will be terminated if a second attempt is made.

All server activity is logged. Any snooping, hacking, or other inappropriate activity of any type outside of your account, on our servers, will be grounds for termination. Your account is provided for routine web and email use only, and any other activities (at our sole discretion) may be grounds for termination as well.

Account suspension: accounts may be suspended for violation of this TOS, or if an invoice is more than 3 days past due. In the event of a past due invoice, all of your billable accounts are subject to suspension. Under suspension, your data will still reside on our servers, but the means to access it (web, FTP, SSH) will be deactivated.

Account termination: accounts may be terminated for violation of any part of this TOS, or if an invoice is more than 30 days past due. No refunds will be granted for pre-paid services on a terminated account, and data can not be recovered or restored under any circumstances. Domains owned through Gladstone Technologies Group, LLC may be transferred to the registrar of your choice once all applicable domain fees are paid in full.

If you are unsure if what you are doing is against our TOS, please contact us. We do not enjoy suspending or terminating accounts by any stretch of imagination, and we are willing to work with you when you speak with us in advance about potential issues.

Amendments

This Terms of Service agreement may be amended, at any time, at the discretion of Gladstone Technologies Group, LLC. Notification of amendments will be emailed to the address we have on file in billing and posted to our website. All accounts are required to comply with any changes made to these policies unless an account cancellation is requested within 7 days of the Terms of Service amendment. You are required to keep a valid and current email address on file with us; we are not responsible for lost or misdirected email. We strongly suggest you check our website frequently for updates to this Terms of Service agreement.

Domain Name Registration and Renewal Policy

All domain name registrations, transfers and renewals we offer are through a licensed third party. We offer domain services through our affiliates only, and prices are not negotiable. You agree not to hold Gladstone Technologies Group, LLC responsible for any domain name registration, renewal, or transfer dispute. We cannot always guarantee that your requested domain name is available for registration, transfer and/or renewal. Your domain name may go unregistered, untransferred and/or renewed, due to circumstances beyond our control, and will not be grounds for compensation of financial loss. An order for domain name registration, transfer and/or renewal does not guarantee domain name registration, transfer and/or renewal.

Definitions

Hosting Accounts: Standard, Managed, or Reseller hosting accounts setup on a server that is shared with other Gladstone Technologies Group, LLC customers.

You/your: All Gladstone Technologies Group, LLC customers, as considered specifically, with access to hosting account services through Gladstone Technologies Group, LLC.
